Who among us hasn't flown a kite? The Coachella Valley's daily breezes make for great kite flying conditions. But one man's love of that hobby has landed him on the wrong side of the law.
Dennis Marshall has gotten hours of enjoyment out of his kite.
"It's very soothing to do it, wind down at the end of the day."
Two of his favorite spots to fly his twenty or so stunt kites are along Country Club Drive in Palm Desert just west of Cook Street and here at Southwest Community Church in Indian Wells.
But Marshall’s kite is not your ordinary design. It's got small LED lights on it. Marshall uses them to see this kite at night. That's when he likes to fly it.
"Every once in awhile, you get an owl or a hawk come in and attack your kite."
But police aren't laughing. While Marshall says he's met other kite lovers who stop to take in the display. An Indian Wells police officer cited Marshall, saying his night kite display is impairing the vision of night drivers.
"If I'm impairing the vision of drivers, what does the tennis stadium do?"
Marshall says he's been doing this for two plus years. He says he waited an hour while five police officers looked for a charge to cite him with and now faces a $125 traffic court fine if he's found guilty of this high flying offense.
"I'd just like to get the blessing of the court to fly. That's all I want."
And he was willing to take his case and his offending kite to court, hoping only to be told go fly a kite.
A judge listened to Marshall's story today in Indio, but didn't make a ruling. Instead, he took the case under advisement and said Marshall will receive an answer to his judgment in the mail.
